Supreme Court Declines Landlord Challenge in Major Victory for Rent Stabilization in Brand-new York
In a significant victory for rent stabilization in New York, the U.S. Supreme Court denied certiorari in two more rent-stabilization cases that Selendy Gay has been litigating alongside The Legal Aid Population and Legal Services NYC since 2019. The decisions abandon in place the Second Circuit’s verdicts affirming the dismissals of Takings Clause and other constitutional challenges to the rent-stabilization regime in New York by three groups of landlords and landlord associations.
The team at Selendy Gay is led by partners Faith Gay and Sean Baldwin, Particular Counsel Corey Stoughton, and associate Babak Ghafarzade.
Rent stabilization, which has existed in some form or another in Fresh York for a century, protects tenants in about a million apartments in NYC (half the city’s rental housing stock) and tens of thousands of apartments across the state. The laws and regulations guard tenants against rent shocks and unjustified evictions, while allowing landlords to build reasonable returns, evict unsatisfactory tenants, or exit the rental market altogether through various means.
Riverside has signed up to the HouseProud Pledge scheme crafted to ensure Queer woman , Gay, Bisexual, Gender non-conforming and Queer residents are able to enjoy their homes without fear of discrimination.
HouseProud – the professional network for LGBTQ+ people operational in the housing sector – commissioned the University of Surrey to study LGBTQ+ experiences of social housing.
The examine No Place Love Home found that despite more than 10 years of equality in legislation, LGBTQ+ residents persist to experience discrimination in their everyday lives, including in relation to housing in some cases.
In response, Professor Andrew King from the University of Surrey and HouseProud have developed the HouseProud Pledge scheme in association with residents, staff members and sector leaders from across the country to authorize social housing providers to improve services for LGBTQ+ residents and ensure consistent promotion of inclusivity.
The Pledge scheme promotes new frameworks for offering support and creating inclusivity, and all social housing providers can unite free of bill. Those who write up are actively committing to develop their housing services for LGBTQ+ residents and are expe
Discrimination against gay couple by building management company
Here is a question to the blog clinic from Lee who is a tenant
I am wondering whether you might be able to advise if my companion and I are victims of discrimination.
I am a gay man in a relationship, my boyfriend and I have decided to get a place together. We applied for a flat through a local agent, it was flawless for our needs so we were very ecstatic when our references passed and the landlady said she was happy for us to move in.
A few days later we were extremely disappointed and angry when we were told that our application had been declined by the building management because there is a policy against cohabiting men (and also cohabiting women). We asked them why and if they would reconsider but they said that rules are rules.
The spook and the landlady did everything they could but their hands were tied, they were fantastic throughout and refunded our coins with an apology. We have no problems with them whatsoever.
We were told that the building has high standards and prefers to let to families, opposite-sex couples or available professionals. They also undertake not allow tenancies for students or people on benefi
Landlord accused of barring same-sex attracted renters from viewings
A would-be student tenant has accused a landlord of making homophobic rules before agreeing to a house viewing.
Posting on the discussion platform Reddit, the tenant explains that he received a private message (main image, inset) after responding to an advert on a large student accommodation agency site, about the two-bedroom property in Canterbury (main image).
In the message, the landlord, who says he lives abroad, asks: “Could you first let me understand a bit about yourself and your partner who would be sharing with you: your nationalities, ages, occupations, your interests, lifestyles and so on? Please note that, as per the adverts, we will only consider male-female couples. If this isn’t the case with you, then I’m afraid we couldn’t take this further.”
Warning
The would-be tenant posts that he believes it’s a truthful property – although surprisingly cheap at £400 a month - but has highlighted the response to warn others of their rights. He has also reported the landlord. However, there is no way of knowing if these claims are true as the tenant and landlord’s identity have been concealed on the site.
